1. Introduction

 

Welcome to DriverXpress. By accessing or using our platform at www.drivewithx.com (“the Website”), you agree to comply with and be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, please do not use our services.

2. Definitions

    •    “DriverXpress” refers to the platform operated by LVX Enterprises LLC that facilitates vehicle rentals between renters and vehicle owners.

    •    “Renter” refers to the individual or entity renting a vehicle through DriverXpress.

    •    “Owner” refers to the individual or entity listing a vehicle for rent on DriverXpress.

    •    “Vehicle” refers to any vehicle listed for rental on DriverXpress.

3. Eligibility to Use DriverXpress

 

3.1 For Renters

    •    Renters must be at least 21 years of age and possess a valid U.S. driver’s license.

    •    Renters must pass a background and driving record check conducted through Checkr or a comparable service, unless exempted under Section 4.4 of the Refund & Cancellation Policy.

    •    Renters must maintain a valid form of payment on file to process deposits, payments, and other fees.

 

3.2 For Owners

    •    Owners must provide proof of valid registration, insurance, and ownership of the listed vehicle.

    •    Owners must ensure that their vehicle meets minimum requirements for rideshare and delivery platforms if applicable.

    •    Vehicles listed on DriverXpress must not be more than 10 years old and must meet all applicable safety standards.

4. Rental Process & Payment Terms

 

4.1 Rental Request and Manual Approval

    •    All rental requests submitted through DriverXpress are subject to manual approval.

    •    Renters may submit multiple requests for the same vehicle, but requests are approved on a first-come, first-served basis.

    •    Payment authorization occurs when a request is submitted, but the renter’s payment method is not charged until the request is approved.

 

4.2 Security Deposit & Background Check Fee Deduction

    •    A $99 security deposit is required for all rental requests and is authorized at the time of booking.

    •    If a background check is required, a one-time background check fee of $49.99 will be deducted from the initial security deposit after manual approval.

    •    The remaining balance of the security deposit will be refunded after the vehicle is returned in satisfactory condition.

5. Cancellation & Refund Policy

 

5.1 Cancellation Policy

    •    Renters may cancel their rental request without penalty if the request is canceled:

    •    More than 24 hours before the rental start date, or

    •    Within 1 hour of submitting the rental request.

    •    If the rental request has been manually approved, cancellation fees may apply as outlined in the Refund & Cancellation Policy.

 

5.2 Refund Policy

    •    Refunds for cancellations or denied requests will be processed based on the timelines outlined in the Refund & Cancellation Policy.

    •    Refunds will be issued to the original payment method used for the deposit authorization.

6. Renter Responsibilities

 

6.1 Proper Vehicle Use

    •    Renters agree to use the vehicle only for legal and authorized purposes.

    •    Renters are responsible for maintaining the vehicle during the rental period, including refueling and keeping the vehicle clean.

    •    Renters are prohibited from using the vehicle for unauthorized rideshare or delivery services unless specifically approved by DriverXpress.

 

6.2 Late Returns & Additional Fees

    •    A 1-hour grace period is provided for vehicle returns.

    •    Late returns beyond the grace period may result in additional charges or penalties deducted from the security deposit.

    •    Renters who repeatedly return vehicles late may be subject to account suspension.

 

6.3 Vehicle Tracking and Monitoring

    •    Some vehicles listed on DriverXpress may be equipped with GPS tracking, remote shut-off, and/or dash cams for safety, security, and compliance purposes.

    •    Renters acknowledge and consent to the use of these systems and agree not to tamper with, disable, or interfere with the functionality of any installed tracking or monitoring devices.

    •    Tampering with GPS or monitoring systems may result in account suspension, forfeiture of the security deposit, and additional penalties.

 

6.4 Return Condition of Vehicle

    •    Renters agree to return the vehicle in clean condition with the same fuel level provided at the time of pickup.

    •    Failure to meet these standards may result in cleaning fees or fuel surcharges being deducted from the security deposit.

 

6.5 Accident & Violation Notification

    •    Renters must notify DriverXpress immediately in the event of an accident, traffic violation, or any incident involving the vehicle during the rental period.

    •    Failure to report incidents may result in penalties, including account suspension and forfeiture of the security deposit.

7. Owner Responsibilities

 

7.1 Vehicle Maintenance

    •    Owners must ensure that their vehicle is properly maintained and meets all required safety standards.

    •    Owners must notify DriverXpress immediately if a vehicle becomes unavailable or inoperable.

 

7.2 Insurance Requirements

    •    Owners are required to maintain comprehensive and collision insurance for their vehicles while listed on DriverXpress.

    •    Insurance coverage must meet minimum state requirements and include coverage for rental use.

    •    DriverXpress is not liable for any damage, loss, or liability that occurs during the rental period.

8. Excess Liability & Non-Payment Policy

 

8.1 Deposit Deduction for Damages or Violations

    •    If a vehicle is returned with damages, traffic violations, or any outstanding issues, the cost of repairs, fines, or penalties will be deducted from the security deposit.

    •    Renters will receive an itemized invoice detailing any deductions, and the remaining deposit balance will be refunded within 3 business days after inspection.

 

8.2 Excess Damages or Violations Beyond Security Deposit

    •    If the cost of damages, fines, or violations exceeds the $99 security deposit, the renter agrees to be financially responsible for the full amount of any remaining balance.

    •    Renters will receive an itemized invoice detailing the excess charges within 5 business days after the vehicle is returned.

 

8.3 Payment of Excess Amounts

    •    Renters authorize DriverXpress to charge the payment method on file for any excess amounts due after the security deposit has been applied.

    •    If the payment method on file is declined or insufficient, renters must pay the outstanding balance within 5 business days of receiving the invoice.

    •    A grace period of 3 additional business days may be provided before initiating collection or legal action if the renter notifies DriverXpress of payment difficulties within the initial 5-day period.

 

8.4 Collection & Legal Action for Non-Payment

    •    If a renter fails to pay the excess amount within 5 business days of notification, DriverXpress reserves the right to:

    •    Initiate collection proceedings through a third-party agency.

    •    Report the outstanding balance to credit bureaus if applicable.

    •    Pursue legal action to recover the amount owed, including reasonable attorney fees and court costs.

 

8.5 Dispute of Excess Charges

    •    Renters may dispute excess charges by submitting a formal dispute request to DriverXpress within 5 business days of receiving the invoice.

    •    Disputed claims will be reviewed, and a final decision will be issued within 7 business days.

 

8.6 Renter’s Agreement for Excess Liability

    •    Renters acknowledge and agree that they are fully responsible for any damages, fines, or violations that exceed the amount of the $99 security deposit.

    •    DriverXpress is authorized to charge the payment method on file to cover any outstanding balance.

    •    In the event of non-payment, DriverXpress may initiate collection proceedings, credit reporting, or legal action to recover the balance owed.

9. Dispute & Resolution Process

 

9.1 Disputes on Refunds

    •    If a renter disagrees with the outcome of a refund or deposit deduction, they may submit a formal dispute request to DriverXpress within 5 business days of the refund notification.

    •    All disputes will be reviewed, and a final resolution will be provided within 7 business days.

 

9.2 Arbitration for Unresolved Disputes

    •    Any disputes that cannot be resolved through internal review will be subject to binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

    •    The arbitration shall take place in Las Vegas, Nevada, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

10. Governing Law & Modification of Terms

 

10.1 Governing Law

    •    These Terms and any dispute arising under them shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.

 

10.2 Modification of Terms

    •    DriverXpress reserves the right to modify these Terms at any time. Updated Terms will be posted on our website, and continued use of our services constitutes acceptance of the modified Terms.
